1. Purpose of these Rules

These Moderation and Content Reporting Rules explain how Recipheon receives reports, reviews User Content, makes moderation decisions, and handles appeals. They supplement the Recipheon Website and App Terms of Use.

2. Scope of moderation

Content and activity subject to moderation may include recipes, photos, comments, replies, profile names, profile pictures, bio descriptions, links, and actions taken through user accounts.

3. Content that may be restricted or removed

Recipheon may restrict the visibility of content, remove or block content, or restrict an account where at least one of the following applies:

– the content is illegal or there are credible grounds to believe that it may violate the law;

– the content infringes copyright, trademark rights, image rights, privacy, personal rights, or other third-party rights;

– the content includes another person's personal data without a legal basis or discloses confidential information;

– the content is offensive or incites violence, hatred, or discrimination;

– the content constitutes spam, fraud, phishing, attempted deception, malware, or other technical abuse;

– the content is clearly misleading as to the authorship, origin, ingredients, or safety of a dish;

– the content promotes conduct dangerous to health or food safety, in particular consuming inedible substances or spoiled products, or using high-risk techniques without an appropriate warning;

– the user repeatedly breaches the Terms of Use or misuses Service features, including reporting mechanisms.

4. Sources of information about infringements

Recipheon may take moderation action:

1) based on reports from users or third parties

2) following its own review

3) based on information from competent authorities

4) with the assistance of automated tools that help detect spam, malicious files, obvious duplicates, or other abuse.

Automated tools are used only to assist the moderation process. Matters requiring a substantive, legal, or contextual assessment should remain subject to human oversight.

5. How to report content

1. A report may be submitted to support@recipheon.com or through the reporting form available next to content in the Service. These Rules apply to both channels.

2. To enable a report to be reviewed efficiently, it should include at least:

a) identification of the reported content and its location (for example, its URL, recipe ID, or comment ID)

b) an explanation of why the content should be considered illegal or contrary to the Terms of Use

c) the reporting person's contact details, unless the law permits a report to be submitted without them

d) a statement or other express confirmation that the reporting person is acting in good faith and that, to the best of their knowledge, the information provided is true and complete.

3. Recipheon may also review an incomplete report if, despite the omissions, it sufficiently identifies the content and the nature of the alleged infringement.

4. Reports concerning an immediate threat to life, health, or safety should be clearly marked as urgent.

6. Acknowledgement and review of reports

1. If a report includes contact details or is submitted through a signed-in Account, Recipheon will acknowledge receipt without undue delay by an appropriate electronic means, such as e-mail or a durable notification within the Service.

2. Reports are reviewed in a timely, diligent, objective, and non-arbitrary manner.

3. In standard cases, Recipheon aims to make a decision within 7 business days of receiving a complete report. Urgent cases involving safety, violence, health risks, or obvious infringements may be decided sooner.

4. Particularly complex cases may take longer. Where possible, the reporting person and the user whose content is concerned will be informed of the delay.

7. Possible moderation actions

Depending on the circumstances, Recipheon may:

1) take no action

2) ask the content author for an explanation or correction

3) add a warning or restrict the visibility of the content

4) temporarily hide the content while the matter is being reviewed

5) remove the content

6) disable commenting

7) restrict account features

8) temporarily suspend the account

9) permanently delete the account in the event of serious or repeated infringements.

The action selected should be proportionate to the nature of the infringement, its impact and scale, the infringer's intent, and their history of previous infringements.

8. Notice of a decision

If Recipheon applies a restrictive measure to content or an account, the affected user will receive the following information, provided that we have their electronic contact details and the law does not provide otherwise:

1) the type of measure applied

2) the factual basis for the decision

3) the contractual or legal basis for the decision

4) whether automated tools were used in the process

5) the available means of appeal.

9. Appealing a decision

1. The content author or the reporting person may appeal a moderation decision by writing to support@recipheon.com.

2. An appeal should be submitted within 14 days of the date on which notice of the decision was delivered or the date on which the interested person could reasonably have become aware of it.

3. An appeal should include:

a) identification of the decision being appealed

b) a concise statement of reasons

c) any new information or documents.

4. Recipheon reviews appeals without undue delay, generally within 14 days. An appeal is reviewed by a person or team under appropriate supervision and, where possible, not involved in making the original decision.

5. Submitting an appeal does not affect the right to pursue claims or defend one's rights under generally applicable law.

10. Misuse of the reporting mechanism

The reporting mechanism must not be used to harass other users, pursue disputes unrelated to the substance of the reported matter, or submit intentionally false, manifestly unfounded, or mass reports. In the event of misuse, Recipheon may restrict further use of the reporting feature or apply other proportionate measures.

11. Records and retention

Recipheon may keep records of moderation, reports, and appeals to the extent necessary to demonstrate that its actions comply with the law and the Terms of Use, and to establish, pursue, or defend claims. Further information about personal data processing and retention is provided in the Privacy Policy.

12. Final provisions

These Rules may be updated to reflect changes to Recipheon features, legal requirements, or moderation practices. The current version is published in the Service.
