§ 1. General provisions
1. These Terms set out the rules for using the Recipheon platform, including the website and the mobile app, where users may create accounts, manage profiles, publish cooking recipes, add photos, comment on content, and report abuse.
2. The operator of the Service is FIAMEKSO SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ. These Terms constitute the terms and conditions for the provision of electronic services and define the rules for publishing and moderating user content.
3. The public website is available in English, Polish, German, French, Spanish, Italian, and Dutch, with English as its default language. If the mobile app is made available, it will be available in Polish, German, French, Spanish, Italian, and Dutch. All published language versions of these Terms are equally authoritative, and no language version takes precedence over another. Any discrepancy shall be interpreted so as to preserve their common meaning and in accordance with mandatory provisions of applicable law. In particular, for a consumer who is a Polish citizen, the Polish version is the basis for interpretation in the circumstances specified in Article 8(1a) of the Act of 7 October 1999 on the Polish Language.
4. Browsing publicly available content without an Account does not require acceptance of these Terms. Creating an Account and using Account features requires acceptance of these Terms and review of the Privacy Policy, Cookie Policy, and Moderation and Content Reporting Rules. A person using a content reporting mechanism without an Account must comply with applicable law and the rules presented for that mechanism.
5. Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Act on the Provision of Services by Electronic Means, consumer protection laws, the GDPR, and, where applicable, the DSA.
§ 2. Definitions
For the purposes of these Terms, the following expressions have the meanings below:
– Service – the Recipheon platform available through a web browser and a mobile app.
– Service Provider – the entity operating the Service and providing electronic services.
– User – a natural person using the Service, including a person with an Account or using content reporting mechanisms.
– Account – an individual set of resources and settings assigned to a User after registration and login.
– User Content – any materials published or submitted by the User in the Service, in particular recipes, titles, descriptions, photos, comments, replies, ratings, comment likes, reports, and other statements or materials.
– Recipe – User Content containing cooking instructions, a description, preparation steps, ingredients, photos, and other related elements.
– Comment – User Content published under a Recipe or other content available in the Service.
– Illegal content – information, materials, or actions contrary to law, including those infringing intellectual property rights, personal rights, privacy, or the safety of other persons.
– Moderation – actions taken by the Service Provider in relation to User Content or accounts, including verification, limiting visibility, removing content, blocking functions, or suspending an Account.
§ 3. Technical requirements and access rules
1. Browsing publicly available content in the Service requires an internet-connected device and an up-to-date web browser or a compatible mobile app version. An active e-mail address is required to create and maintain an Account and to use features available after sign-in, in particular publishing User Content, commenting, saving recipes, and managing the profile.
2. The Service Provider may carry out technical work, updates, tests, security activities, and maintenance breaks. The Service Provider will, where possible, announce planned breaks that materially affect availability in advance.
3. The User should use the Service in accordance with its intended purpose, these Terms, the law, and accepted standards of conduct, while respecting third-party rights.
§ 4. User Account
1. Creating an Account requires providing the data indicated in the registration form, in particular an e-mail address, username, and password, or using an available social login mechanism.
2. The User must provide true, current, and non-misleading data and may not impersonate another person, brand, or entity.
3. A username or profile name must not violate the law, accepted standards of conduct, or third-party rights. The Service Provider may require it to be changed or may restrict the visibility of a name that violates the law or these Terms.
4. The User is responsible for keeping their sign-in credentials confidential and for actions taken through their Account, unless the User demonstrates that they were not at fault.
5. The User may delete the Account at any time from the Service settings or submit such a request to the Service Provider. The effects of deleting an Account are described in § 10 of the Terms and in the Privacy Policy.
§ 5. Rules for publishing User Content
1. The User may publish in the Service only such content for which the User has the relevant rights and the publication, storage, public availability, and use in accordance with these Terms do not infringe the law or third-party rights.
2. In particular, the following may not be published: a) unlawful content; b) content infringing copyright, image rights, trademarks, trade secrets, or personal rights; c) content containing other people's personal data without a legal basis; d) spam, phishing links, malicious content, or content intended to destabilise the Service; e) content misleading as to the origin, authorship, or properties of a dish; f) dangerous content, including encouraging the consumption of dangerous, spoiled, toxic products or the use of ingredients not intended for consumption; g) offensive content, incitement to violence, hatred, or discrimination.
3. The User should prepare recipes and comments carefully and accurately. If a recipe involves potential allergens, raw ingredients, fermentation, preserving food, food for children or pregnant women, elimination diets, or other situations requiring particular caution, the User should make this clear in the recipe.
§ 6. Rights to User Content and licence for the Service
1. The User remains the owner of the User Content and retains economic and moral copyrights to the extent they belong to the User.
2. Upon publishing User Content in the Service, the User grants the Service Provider a non-exclusive, royalty-free, worldwide licence for the period during which the content remains in the Service, and, with respect to backups, technical archives, and material necessary to handle reports, incidents, and claims, for the period resulting from justified technical or legal needs.
3. The licence covers the uses necessary to operate and develop the Service, in particular: a) recording and reproducing the content using any digital technique; b) storing, hosting, indexing, displaying, and making the content available to the public within the Service; c) making technical changes necessary for the Service to function properly, including compression, scaling, cropping, thumbnail creation, file format conversion, and optimisation of quality and technical parameters; d) marking photos and materials with a Service watermark, profile name, username, or other source identifier when publishing, sharing, or promoting the content; e) using the content to present, promote, and recommend content within Service features, including 'top recipes' sections, editorial selections, rankings, home screens, newsletters, and social media channels operated by the Service Provider; f) translating and linguistically localising the content into languages supported by the Service, including through automated tools, by adapting culinary terminology, units, structure, and metadata without intentionally changing the substantive meaning of the content, and using and disposing of the resulting adaptations within the fields of use specified in this section.
4. The licence authorises the Service Provider to use the User Content directly or through technical suppliers acting on its behalf to the extent necessary to achieve the purpose of the licence.
5. The Service Provider does not acquire ownership of the User Content. As a rule, the licence expires upon the permanent removal of content from active Service systems, subject to paragraph 2 and § 10.
§ 7. User representations concerning content
By publishing User Content, the User declares that: 1) the User is entitled to publish it and to grant the licence specified in these Terms; 2) the content does not infringe the law or third-party rights; 3) regarding image rights, third-party photos, graphics, packaging elements, trademarks, or other protected elements, the User has the relevant consents or legal basis; 4) the User assumes responsibility for the consequences of infringements resulting from the unlawful nature of content published by the User.
If an infringement report is made, the Service Provider may request additional explanations or documents from the User confirming the right to use the given content.
§ 8. Moderation, content removal, and account restrictions
1. The Service Provider may take moderation actions against User Content or an Account if the content is illegal, contrary to these Terms, or creates a justified risk to the safety of the Service or other persons.
2. Moderation actions may include in particular: a) refusing publication or withholding publication; b) hiding content, limiting its visibility, or removing it; c) disabling commenting; d) temporarily limiting Account functions; e) temporarily suspending the Account; f) permanently deleting the Account in cases of material, serious, or repeated infringements.
3. Moderation may be initiated ex officio, based on a user report, by an authorised entity, or with the use of automatic tools supporting the detection of spam, abuse, malicious files, duplicates, or obvious infringements. In disputed matters, the final decision is not made solely automatically.
4. The Service Provider acts diligently, objectively, and proportionately, taking into account the rights and legitimate interests of all interested parties.
5. If the Service Provider applies a restrictive measure to content or an Account, it will provide the User, to the extent required by law and technically possible, with information about the basis of the decision and available means of appeal.
§ 9. Comments and community interactions
1. Comments are intended for the exchange of experience regarding recipes, their modifications, and methods of preparing dishes. Comments should remain factual and related to the topic.
2. Users must not publish comments containing advertising not agreed with the Service Provider, harassment, trolling, flooding, provocations, offensive content, or another person's personal data or confidential information.
3. The Service Provider may limit the commenting function in relation to selected content, users, or categories of infringements if required for the safety of the Service or the order of discussion.
§ 10. Account deletion and its effects
1. Deleting an Account, as a rule, results in the permanent deletion of account data and the User Content assigned to that Account, including recipes, comments, and other materials, without anonymisation, subject to paragraphs 2–5.
2. Deletion takes place without undue delay. Data is removed from active production systems, as a rule, within 30 days of the effective submission of the request, and from backups in their overwrite cycle, as a rule, within 90 days, unless earlier deletion is technically possible and justified.
3. The Service Provider may retain selected data despite Account deletion if this is necessary for: a) compliance with a legal obligation; b) establishing, pursuing, or defending claims; c) demonstrating the lawfulness of the Service Provider's actions; d) handling, documenting, or closing infringement reports, security incidents, or proceedings conducted by authorised authorities.
4. If User Content was previously shared in external services or copied by other users outside the Service, the Service Provider is not responsible for removing copies outside its control.
5. After deleting the Account, the User loses access to data, settings, saved content, and activity history, unless the law requires further access to them.
§ 11. Complaints regarding the operation of the Service
1. Complaints concerning the operation of services provided electronically may be submitted to support@recipheon.com.
2. A complaint should contain at least data allowing the identification of the complainant, a description of the problem, and, where possible, the date, time, and circumstances of its occurrence.
3. The Service Provider answers a consumer complaint without undue delay, within 14 days of receipt, on paper or another durable medium. A request for further information does not extend this deadline. Failure to answer on time has the consequences set out in Article 7a of the Polish Consumer Rights Act.
§ 12. Disclaimers concerning recipes, allergens, and safety
1. Content available in the Service, in particular user recipes and comments, is provided for information, inspiration, and community interaction. It does not constitute medical, dietary, allergy-related, or food hygiene advice, nor does it guarantee that a dish can be prepared or consumed safely.
2. The User should in each case independently verify: a) the ingredients and their origin; b) the presence of allergens and the possibility of cross-contamination; c) temperatures, cooking times, and safe food storage rules; d) whether the recipe is suitable for the User's health condition, diet, age, pregnancy, allergies, intolerances, and specialist recommendations.
3. Particular caution should be exercised with recipes for children, older people, pregnant women, people with allergies, elimination diets, or chronic conditions, and with dishes containing raw ingredients.
§ 13. Liability
1. The Service Provider exercises due care so that the Service operates properly, safely, and in compliance with the law, but does not guarantee uninterrupted availability of all functions at all times.
2. The Service Provider is not responsible for User Content, subject to cases provided for by applicable law, in particular where, after obtaining reliable information about the unlawful nature of content, it is obliged to take appropriate action.
3. Nothing in these Terms excludes or limits the liability of the Service Provider towards a consumer or a natural person benefiting from consumer rights to the extent that such exclusion or limitation would be impermissible.
§ 14. Premium and Recipheon AI usage allowance
1. A new account receives 7 days of trial Premium, measured as 7 × 24 hours from account creation, and its own AI usage allowance, valid only until the trial ends. Email verification, a residence declaration and acceptance of the terms are required before the first session; they do not extend the trial or renew the allowance. The trial does not start paid renewals. New operations require active Premium and enough allowance for a reservation. The allowance is not a payment instrument: it cannot be bought separately, transferred or redeemed for money. Unused allowance expires with its period without rollover.
2. Paid Premium is a separate contract of indefinite duration with monthly billing for adult consumers acting on their own behalf and usually living in Poland. Plans: Basic PLN 12.49, Plus PLN 19.99, AI MAX PLN 29.99; subscription prices are final in PLN. Each period starts with 100% of its own allowance. Consumption is based on the type and size of completed AI calls and the saved usage rate version. We do not guarantee a number of recipes, illustrations or attempts. Reserving part of the allowance using a conservative usage estimate is not consumption; unused reservation is released after settlement. Clarification, refusal or invalid output after an AI call may consume allowance. Blocking before a call consumes none; a confirmed AI provider failure releases the user reservation for the call without a delivered response even if settlement of that call is not yet complete. An unknown outcome without a confirmed failure remains pending reconciliation. When buying during the trial, payment is made now and the paid period and allowance start after the original trial end or later payment confirmation. We show the planned date before ordering; trial allowance does not carry over. Without an active trial, the period starts after payment confirmation.
3. Ordering requires separate acceptance of versioned terms and authorisation of monthly charges. A request to start before the 14-day withdrawal period ends is separate and does not remove statutory rights. You can disable renewal on your account while retaining the paid period; plan changes apply from the next period. Unconfirmed payment grants no allowance. No new operations start after Premium expires; accepted tasks, history and saved results remain available under their applicable rules. New operations require the current terms and allowance policy; a scoped repair of a current session keeps its own scope and deadline even after Premium expires. Account deletion stops future renewals. Consumers can generally withdraw within 14 days of contracting through the panel or support@recipheon.com; we answer complaints within 14 days. Allowance consumption does not remove rights concerning service conformity or money refunds. Charging for the performed part requires a legal basis and individual assessment; the percentage used does not alone determine a deduction. Detailed terms shown before purchase and the durable confirmation define these rights. The current offer remains a closed test using demonstration or Przelewy24 sandbox, without real money or public sales.
§ 15. Changes to the Terms and final provisions
1. The Service Provider may amend the Terms for important reasons, in particular due to the development of the Service, changes in functionality, the need to adapt to law, security, or changes in service providers supporting the operation of the Service.
2. The Service Provider will inform Users of material changes to the Terms with appropriate notice through the Service, by e-mail, or through another commonly accepted communication channel.
3. A User who does not accept the changes to the Terms may delete the Account and stop using the Service.
4. These Terms enter into force on 10.10.2026.
